Commitment to Protect your privacy

The Build Store recognizes the importance of your privacy and how important it is to us to protect your personal information. We are committed to protecting the personal information we hold and comply with all relevant privacy laws in the jurisdictions in which we operate. This document describes how we manage your personal information and protect your privacy.

References to ‘The Build Store’, ‘TBS’, ‘we’ and ‘us’ means The Build Store Pty Ltd. www.thebuildstore.com.au (the “Site”) is owned and operated by The Build Store Pty Ltd.

Purpose

We collect, use and disclose your personal information to conduct our business; in order to:

a) provide, manage, improve and personalize our products and services;
b) identify you and interact with you;
c) let you know about other products and services that may be of interest to you;
d) evaluate and improve the quality of our products and services;
e) protect our legitimate interests;
f) deal with your concerns and inquiries;
g) generally assist us in managing our transactions with you, suppliers, consumers and others.

This Privacy Policy applies in addition to the terms and conditions of TBS.

Consent
By using our Site users agree that they consent to:

a) The conditions set out in this Privacy Policy; and
b) The collection, use, and retention of the data listed in this Privacy Policy.

Personal Data We Collect
The type of information we collect and hold about you may include your name, address, telephone numbers, email address, bank account and credit card details, date of birth, identification information and organisation. If you apply for trade account, we may also collect and hold credit information about you.

The type of personal information we collect and hold depends on the types of products and services we provide for you. We may collect your personal information:

a) when you request products or services from us or enter our competitions;

b) when we record any of your correspondence and other interactions with us (including phone calls, emails and online); and

c) If you own or own one of our products, when we record information about your use of that product or your opinion about it, when you respond to a survey.

The types of information we collect and hold about you may include your name, address, telephone number, email address, bank account and credit card details, date of birth, identity information and organisation. If you apply for a trading account, we may also collect and hold credit information about you.

We also collect information about you when you use our website. We generally collect personal information directly from you where reasonably practicable. We may also collect personal information from other parties such as service providers, our agents or representatives, your employer, your agents or representatives (such as your advisors) and publicly available sources.

If you do not provide the information we request

The personal information we request is generally optional, but if you choose not to provide us with personal information, we may not be able to fulfill your request or provide you with the products or services you require. However, sometimes, in certain circumstances, we are required by law to collect certain personal information from you, in which case we will take reasonable steps to inform you of the law implementing this requirement.

How We Use Personal Data
Data collected on our Site will only be used for the purposes specified in this Privacy Policy or indicated on the relevant pages of our Site. We will not use your data beyond what we disclose in this Privacy Policy.
We may contact you by telephone, mail, electronically or otherwise to provide you with marketing, advertising or other materials about our products and services that we think may be of interest to you, or to follow up on your inquiries about specific products and services interest, unless or until you tell us not to or we are restricted by law. We may also disclose your personal information to market research agencies who may similarly contact you to conduct market research on products and services you obtain or provide from The Build Store and related matters (unless or until you tell us not to). If you do not wish to receive direct marketing communications or would like to change your contact preferences, please contact us (see “How to Contact Us” below).

We may also exchange information with our service providers, including advertising agencies, accountants, auditors and lawyers, credit reporting and collection agencies and archives, banks , payments, data processing, data analysis, information brokerage, research, surveys, websites and technical services. We may also disclose your personal information in the context of a corporate transaction involving the transfer or corporate reorganization of all or a portion of our assets (including liabilities) or business.

We may also be required or authorized by law to disclose your personal information. For example, we may respond to subpoenas or disclose your personal information to relevant tax authorities. We may also disclose information to others if you have given us your consent to do so.

Some of the third parties to whom we disclose personal information may be located in New Zealand, Singapore, South Korea, the Republic of China, the United States of America, the United Kingdom, throughout the European Union and other countries, and you acknowledge that while they are generally bound by confidentiality or privacy obligations, they may not always comply with the requirements of the Australian Privacy Laws.

How Long We Store Personal Data
User data will be stored until the purpose the data was collected for has been achieved. You will be notified if your data is kept for longer than this period.

Hold and protect your personal information

We store personal information electronically and in hard copy. We take reasonable steps to protect your personal information from loss, misuse, modification or unauthorized access, use and disclosure. These steps include access controls to our buildings, confidentiality obligations imposed on our employees and service providers, and the use of security measures for access to computer systems.

Once we no longer need your personal information for any of the purposes for which it was collected, we will take reasonable steps to destroy or de-identify your personal information, subject to any legal obligations and responsibilities.

Your privacy on our websites

This privacy policy also applies to the websites operated by us under domain names (thebuilderstore.com.au).

We operate websites that may use “cookies” to collect personal information. A cookie is a small file that a website stores on your hard drive. A cookie contains information that can be read by the website that issued the cookie to you. A cookie cannot execute programs or access other information on your computer. Your web browser can be configured to refuse cookies from our website, but if you do this, some features offered on our website may be unavailable as a result.

When you visit our website, we may collect the following information from you: your IP address, domain name, date, time and duration of your visit, the pages and files you visit, the website you visited before (i.e. referring URL) , the type of browser you are using and information you voluntarily provide, such as survey information, name and email address.

While we take care to protect the personal information you provide to us on our website, the Internet is not a secure environment. If you are considering sending us any personal information via our websites, otherwise, please be aware that the information may not be secure during transmission, especially if encryption is not used (e.g. email, standard HTTP ). We are bound by laws that require us to protect information once it comes to us.

You may visit external websites operated by companies not affiliated with us by clicking on the links we provide. These other sites are not governed by our privacy standards, and we are not responsible for their privacy practices or the content of such other sites. You should contact those sites directly to determine their privacy standards, policies and procedures.

Credit reporting

This section applies to our processing of personal information from credit reporting agencies (CRBs) and certain other personal information relating to consumer credit (credit information) as described below. We generally process credit information in the context of commercial credit rather than consumer credit arrangements. For example, we may process information about the creditworthiness of an individual consumer if we extend trade credit to an individual trader, or if a director personally guarantees trade credit we extend to a company.

We may collect and hold any type of credit information about individuals as permitted by the Privacy Act, including:

a) name, gender, date of birth, driver’s license number, employer and three most recent addresses;

Acknowledgment of previous requests for information about individuals made to the CRB by other credit providers and credit insurers;

b) details of previous credit applications, including the amount and type of credit and credit limits;
c) details of current and previous credit arrangements, including credit provider, start/end dates and certain terms and conditions;
d) Permitted payment default information, including information about payment arrangements and subsequent repayments;
e) information about serious credit infringements (e.g. fraud);
f) information about adverse court judgments and bankruptcy;
g) publicly available information about an individual’s creditworthiness; and
h) Any credit score or credit risk assessment that demonstrates the CRB’s or credit provider’s analysis of an individual’s eligibility for consumer credit.

This credit information may include information about your arrangements with other credit providers and with us.If we collect credit information about you from the CRB, we may use that information to make our own assessment and rating of your creditworthiness.

We may disclose credit information to the CRB to assist the CRB in maintaining information about you for use by other credit providers for credit evaluation. We may collect credit information from the CRB for purposes including, to the extent permitted by law, assessing your credit or guarantee application, administering your credit/guarantee, allocating debt and collecting overdue payments. We may also exchange credit information with debt purchasers and other credit providers.

You have the right to ask the CRB not to:

a) Use your credit information to determine your eligibility to receive direct marketing from credit providers; and
b) Use or disclose credit information it holds about you for a period of 21 days (without your consent, known as the “prohibition period” if you have reasonable grounds to believe that you have been the victim of fraud, including identity fraud). When you apply for credit, you are deemed to consent to us accessing your personal information (including credit-related information) held with credit reporting agencies, even if an embargo period exists, to assess credit applications or collect overdue payments.

How to Access, Modify, Delete, or Challenge the Data Collected
If you would like to know if we have collected your personal data, how we have used your personal data, if we have disclosed your personal data and to who we disclosed your personal data, or if you would like your data to be deleted or modified in any way, please contact our privacy admin here: admin@thebuildstore.com.au. We may require you to complete a request form.

You can also contact us to ask us to stop using your personal information to contact you about our products and services. If you would like more information about the way we manage your personal information, or if you are concerned that we may have breached our privacy obligations and wish to make a complaint, you may contact us.

If you file a complaint, we will endeavour to respond to and resolve your complaint promptly. If your complaint is about credit information, we may need to check with the CRB involved. We will notify you that we have received your complaint (usually within 7 days). We will keep a record of your complaint and keep you updated on steps we are taking to help resolve your complaint. We typically provide a final response within 45 days.

Modifications
This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the “Effective Date” at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.
